Terms of Uploading Content and Behavior at Amateri.com

(“TUC”)

I. Introductory Provisions

  1. These TUC regulate the content upload rules and user behavior rules on the Amateri.com platforms (hereinafter referred to as “Amateri.com”).
  2. These TUC supplement the General Terms and Conditions (“GTC”) in accordance with the provisions of Art XII (5) of the GTC.

II. Personal Description Rules

  1. Personal description means the description of the user that is displayed in the user profile, and unless otherwise stated, the personal description has the nature of personal information.
  2. In the personal label, it is prohibited to
    1. insult or attack individuals or groups,
    2. express hatred using words or symbols,
    3. initiate or incite topics prohibited by law,
    4. sell or solicit illegal or regulated goods,
    5. link to other websites,
    6. act fraudulently or provide false information,
    7. violate the law on intellectual property and related copyrights,
    8. provide contact information (does not apply to private, non-public interaction).
  3. The personal description rules, unless otherwise stated, also apply reasonably to the description of an album, video, photo, blog and other similar content, as well as to communication between users.

III. Profile Photo Rules

  1. Profile photo means a photo defining the user in the user profile.
  2. It is forbidden to use photos as profile photos
    1. of children or persons under the age of 18 or giving the impression that they are children, including in the case of avatars, drawings, anime and other similar categories,
    2. with animals whose depiction contradicts public order and morality,
    3. depicting mainly, but not exclusively, violence, blood, drugs, hateful gestures and symbols defaming the human race or otherwise contrary to public order,
    4. of other persons, especially public figures,
    5. downloaded from the Internet or other publicly available source,
    6. with a watermark other than Amateri.com.

IV. Rules for Album Creation and Its Content

  1. The album must be focused on erotica and related topics.
  2. The content of the album must be categorized according to the subtopics that best describe its focus.
  3. Album content should not be duplicated in other albums; it is at the discretion of the provider or an authorized person whether to approve the upload of a duplicate or not.
  4. It is strictly forbidden to upload content without the knowledge of the persons appearing in the content.
  5. For optimal profile performance, it is recommended to upload 6 to 30 photos to an album, with a maximum size of 10 MB per photo.
  6. It is forbidden to upload photos and videos with a watermark.
  7. Photos and videos must be original, not reproduced or otherwise adapted.
  8. Videos must have a minimum footage of 15 seconds and the maximum allowed size of one video is 1000 MB.
  9. Photos and videos must not capture, directly or indirectly, content the depiction of which is prohibited by law, or content that by its nature may create a misleading impression or evoke illegal substances or conduct prohibited by law.
  10. In the event that a user is excluded by the administrator on the basis of repeated or serious violation of the rules, such a user is not entitled to compensation.

V. Blog and Post Rules

  1. Textual content on a blog is called a post.
  2. Contributions can only be entered in the user's profile and displayed in the statement at www.amateri.com/en/blog, other locations of the blog are inadmissible.
  3. Individual contributions must be classified in the appropriate categories according to their focus.
  4. The content of the blog must not contradict the laws of the Czech Republic and the rules of Amateri.com.
  5. It is strictly prohibited in posts to
    1. insult or discriminate against anyone,
    2. incite violence, conflict or crime,
    3. promote, sell or solicit substances and products prohibited by law,
    4. ridicule or systematically harass other users and employees of Amateri.com,
    5. publish information about victims of crimes, especially juveniles,
    6. publish contact information.
  6. The blog and its individual posts cannot be used to announce public collections and similar calls.
  7. The rules of the blog and posts will also apply appropriately to forum posts on Amateri.com.

VI. Chat Rules

  1. Chat means interaction through messages in a text thread between two or more users within the chat room at Amateri.com.
  2. The administrator of each chat room is a person designated and authorized by the provider of Amateri.com.
  3. The administrator assesses the permissibility of the behavior of individual users in a given chat room in accordance with the rules of Amateri.com, and punishes unacceptable behavior appropriately and within the limits of these TUC.
  4. The administrator of the chat room has the following tools at their disposal for remediation in case of violation of the rules:
    1. Warning: The user is warned about inappropriate behavior that violates the rules.
    2. Temporary Mute: The user is temporarily prevented from contributing to the discussion, but can still remain in the room.
    3. Temporary ban the user from the room: The user is temporarily banned from participating in the chat room.
    4. Permanent ban of the user from the room: The user is permanently banned from participating in the chat room and is prevented from being added in the future
    5. Temporary block of the user's account: The user's account is temporarily blocked, the user will lose access to the account for a limited time.
    6. Permanent block of the user's account: The user is permanently excluded from the Amateri.com community.
  5. The administrator of the room is obliged to properly justify the use of any of the tools used to arrange redress of the user; the use of these tools is possible only on the basis of prior notification of the user by the administrator.
  6. Impersonating an administrator is considered a serious violation of TUC.
  7. It is strictly prohibited in the chat room
    1. insult, attack or discriminate against anyone based on gender, race, religion, sexual orientation and other criteria,
    2. threaten anyone with violence, provoke arguments and disputes,
    3. enter contact information, offers or requests for erotic services and sex,
    4. use an excessive amount of emoticons that clutters the chat room; similarly, so-called wallpapering is prohibited, which means the unreasonable repetition of the same text, image or animation with the aim of cluttering the chat room, thereby making the smooth progress of the chat impossible or difficult,
    5. invite other users outside the platform provided and guaranteed by Amateri.com to another, external platform (e.g. Skype or MSN, etc.).
  8. Each room can have its own individual rules, while their content must not contradict the TUC or reduce their standard.

  10. In the event that a user is excluded by the administrator on the basis of repeated or serious violations of the rules, such a user is not entitled to compensation.
  11. The Creator (see Rules for Creators) can set up a chat room, the entrance of which is charged with credits ("Monetized Room"), while the amount of credits is determined by the creator themself; this amount can be moderated by the operator or an authorized person.
  12. Paid credits are assigned to the founder of the given room after deducting the provider's commission; any complaints are governed by the Complaints Policy (see Complaints Policy).
  13. The Monetized Room is governed by the rules of Amateri.com and the rules determined by the founder of the given room; the rules of the founder must not lower the standard given by the rules of Amateri.com or contradict them in any way, and visitors to such a room are obliged to comply with these rules.
  14. There is no legal right to enter and stay in the Monetized Room, even if the user in question has a prepaid VIP membership; VIP membership is in no way related to the Monetized Room, unless specifically stated otherwise.
  15. The same remediation tools can be applied in the Monetized Room as in any other room; membership in the Monetized Room does not grant its participants increased tolerance in terms of breaking the rules.

VII. Disclaimer

  1. The provider of Amateri.com declares that an employment relationship does not arise between him and the user through the use of the portal.
  2. The provider further declares that the opinions of any persons expressed on the blog or other publicly available places may not be in accordance with the position and opinions of the provider, and therefore cannot be considered as the provider's opinions.
  3. The provider further declares that, despite all efforts and necessary care, it is not possible to monitor all user communication on the website.
  4. The provider is not responsible for the behavior of individual users on the website, especially for activity that violates the law, the protection of the rights of third parties, the copyright law and the protection of privacy and freedom.
  5. The provider has the right to monitor communications, texts and other content that is published on Amateri.com or sent between users, in order to ensure safety and compliance with the rules.

VIII. Final Provisions

  1. These TUC take effect on October 10, 2023.
  2. The provider reserves the right to change these TUC unilaterally.
