Credit System Rules

(„CSR“)

I. Introductory Provisions

  1. These CSR regulate the rules of acquiring, transferring and using credits at Amateri.com platforms (hereinafter referred to as “Amateri.com”).
  2. These CSR supplement the General Terms and Conditions (“GTC”) in accordance with the provision of Art VI (1) of the GTC.
  3. Definitions, names and references not specified in these rules follow their meaning according to the GTC.

II. Definitions

  1. Credit means a pre-paid, unspecified service at Amateri.com which is drawn while simultaneously reducing the credit holder’s credit account balance.
  2. Service means any service at Amateri.com that requires credits to purchase.
  3. A virtual wallet means a user account which has at least 1 credit.
  4. A credit holder is a user who has at least 1 credit in their user account.
  5. The credit holder is a consumer only if they purchase credits on their own user account and using their own funds when, in the sense of Art 1724 of Act No. 89/2012 Sb., Civil Code, as amended (“CC”), they have entered into a credit purchase contract with the provider of Amateri.com (“Provider”).
  6. The contract within the meaning of (5) is concluded at the moment when the acquirer of credits accepts the Provider’s offer by paying the given purchase price through one of the payment methods provided by third parties.
  7. Third party means a qualified payment intermediary according to the Provider’s current offer.

III. Acquisition of Credits

  1. The user may acquire credits
    1. by purchasing them according to Art II (5),
    2. by obtaining them from another user (donation),
    3. as a reward or compensation from the Provider, or
    4. through their own content.
  2. The exchange rate of credits against the Czech crown is always indicated for the relevant transaction.
  3. For the acquisition of credits for the benefit of the user according to (1) the Provider is entitled to a fee of 20% of the value of the acquired credits.
  4. Given that the user is sufficiently informed about the consequences of such actions before purchasing credits, including the possibility to choose the required amount of credits prior to acquiring them, the provisions of Art 583 et seq. CC regarding mistakes shall not apply.

IV. Transferring Credits

  1. The credit holder may donate (transfer) their credits to another user.
  2. When transferring credits, the consumer’s rights and obligations do not transfer from the original credit holder to the transferee.
  3. The user donating credits to another user donates credits on the basis of their own decision and completely voluntarily, thus the consequences of such own actions cannot subsequently be claimed against the Provider.
  4. It is forbidden to require deposits and payments for services offered at Amateri.com other than through the Amateri.com credit system.
  5. A user who violated the provisions of (4) does not have the right to appeal to the Provider for the invalidity of such own actions, and therefore neither any compensation; this provision applies to both the recipient and the payer.

V. Using Credits

  1. The credit holder may use the credits to consume services at Amateri.com, while the price is always indicated for each specific service.
  2. In the event of a complaint by a user using the service or services at Amateri.com, the user is obliged to proceed in accordance with the Complaints Policy.
  3. Credits are in no case used to pay for personal meetings between users, especially not for erotic and other services.

VI. Special Provisions on Retention Credits

  1. Based on the operator's individual decision, selected users may be required to maintain a certain number of credits in their user account (“Retention Credits”), while if the balance of credits in the user's account falls below the specified minimum, such user may be restricted from accessing individual parts of Amateri.com, or completely blocked.
  2. The Operator reserves the right to designate users who are liable for Retention Credits at its sole discretion; the main reasons for such a measure include in particular: circumvention and violation of the rules, repeated fraudulent behavior, problematic history in the account.
  3. The established obligation to Retention Credits, as well as their amount, may change, depending on the behavior of the user and the decision of the provider.

VII. Final Provisions

  1. The disbursement of credits in the form of funds is governed by the Terms of Disbursement.
  2. In case a user account is canceled at the user's request or deleted as a result of a violation of Amateri.com rules, all accumulated credits in such an account shall be lost, without the right to compensation.
  3. These CSR are valid and effective as of 1. 10. 2023.
  4. In the event of a discrepancy between the individual language versions of these CSR, the Czech version shall prevail.
  5. The rights and obligations arising from these CSR are governed by Czech law.
  6. The provider reserves the right to change these CSR unilaterally and without prior notice.
