The purpose of these ToD is to set out the conditions under which a user of the Amateri.com platforms (hereinafter referred to as “Amateri.com”) may exchange the obtained credits for funds.
These ToD are the only and complete Amateri.com regulation governing the disbursement of funds to users.
By submitting a request for the payment of credits in the form of funds, the user unconditionally agrees to the wording of these ToD.
II. Terms of Disbursement
A user who has accumulated at least the number of credits on their user account that is listed in the current offer at https://www.amateri.com/en/wallet/ can request their disbursement.
Before a user requests disbursement from their user account, they must
verify their identity by means of an identity card, passport or other qualified means of
identification,
verify their identity through a photo (more in Art V (2) of the GTC),
conclude a License Agreement with the Amateri.com provider for the content that the user has uploaded,
uploads or shall upload to Amateri.com server, even if they do not intend to upload any content,
The exchange rate of credits is defined at the time of payment, and this exchange rate is shown at https://www.amateri.com/en/wallet/ before the transaction is carried out.
Funds can only be paid out to the account of the user requesting disbursement, not to the account of a third party.
It is strictly prohibited to abuse the credit system, especially uploading and paying out credits within one account.
A user who uses the practices mentioned in the previous paragraphs may be asked by the operator of Amateri.com to provide an explanation and document decisive facts, and in the event that they do not respond to such requests, their account may be suspended or completely canceled.
Credits are paid out in the form of funds within 7 days of entering the order by the user, unless the user is told otherwise.
A user who wants to change the target bank account intended for payment in any way is obliged to prove the ownership of the account and the reason for which they request the change, otherwise, the account change shall be rejected.
There is no legal right to the payment of credits in the form of funds.
The operator of Amateri.com and the authorized persons can at any time investigate the origin of the acquired credits of the user who requests their payment and, in case of doubt, request additional information, documents or other evidence testifying in favor of the given user; in the event that the user does not comply with such a request, the payment of credits in the account of the given user may be temporarily or permanently blocked.
Payment of credits may also be denied if potentially harmful or otherwise objectionable activity is detected in the user's profile.
III. Declaration of User
A user who successfully meets the conditions set out in these ToD also declares that
shall not use the obtained funds illegally, i. e. for instance to finance terrorism or organized
crime;
shall declare the income from the Amateri.com activities in a timely and proper manner to the respective
authorities in accordance with the financial and tax laws of their country, while understanding that the
Amateri.com provider and their employees are not obliged to fulfill the user’s legal obligation on their
behalf;
is aware of the consequences of violating these ToD, General Terms and Conditions and the relevant legal
regulations, whether intentionally or unintentionally, both by act and omission.
The user further declares that
if their income from activities at Amateri.com for the last 12 months exceeds the amount of 10,000 euros or the equivalent in Czech crowns, and / or
if the user is paid more than twice in the past 30 days,
the user shall apply for registration in the trade register in accordance with legal regulations of their country, while the user subsequently proves the successful registration to the Amateri.com provider with an extract from the trade or similar register.
The user acknowledges that if the requirement in (2) is not met, the user cannot be paid from Amateri until these requirements are met.
In the event that execution or insolvency proceedings are conducted against the user, the Amateri.com provider has the right not to pay the amount in question, and to suspend or cancel the paid cooperation with the user.
IV. Final Provisions
These ToD become valid and effective on 1. 10. 2023.
In the event of a discrepancy between the Czech and English versions, the Czech version shall prevail.
