Terms of VIP Membership

I. Introductory Provisions

1. These TVIP govern the rules of the VIP account and its use on the Amateri.com platforms (hereinafter referred to as “Amateri.com”).
2. These TVIP supplement the General Terms and Conditions (“GTC”) in accordance with the provisions of Art VII (2) of the GTC.

II. Definition and Acquisition of the VIP Membership

1. VIP membership means a user account on Amateri.com that has been upgraded to a higher level of exclusivity based on activation, enabling the user to use VIP services (“VIP Services”).
2. VIP membership can be obtained
   1. by a one-time payment by a registered user, or
   2. by repeated payment by a registered user with the possibility of automatic extension, or
   3. as a gift from another registered user, or
   4. in exchange for registered user credits.
3. By activating a VIP account, the Registered User becomes a VIP User (“VIP User”).

III. Using VIP services

1. The VIP user receives VIP services according to the current offer of the provider Amateri.com.
2. In the event of temporary unavailability of any of the offered VIP services, the VIP user is not entitled to compensation in any form, even if the service in question has ceased to be completely available.
3. VIP functions available in the mobile application are not always necessarily accessible in the web application and vice versa; the unavailability of a function in one of the interfaces is not a legitimate reason for a service complaint.
4. It is entirely at the discretion of the VIP user whether or not to use the VIP service; in the event that the user does not use the services, however, they are not automatically entitled to a refund, not even in the form of credits.
5. In no case does the provider guarantee the functionality of all elements from the website at the mobile application; malfunction of the mobile application is not a reason for a complaint.
6. Based on the decision of the provider or an authorized person, access to certain parts of Amateri.com may be restricted to VIP users only; users who do not have a VIP membership cannot claim access to such a section from the provider.
7. VIP membership does not apply to and is in no way related to monetized rooms (see Terms of Uploading Content and Behavior, Art VI (11) - (15)).

IV. Cancellation and Termination of the VIP Membership

1. User may cancel their VIP membership at any time through their User Account.
2. VIP membership can only be refunded in the form of credits and on the condition that the VIP user has not yet used any of the offered VIP services, based on the decision of the provider of Amateri.com or an authorized person.
3. Refund of the VIP membership in the form of credits is possible only at the discretion of the provider of Amateri.com, taking into account the special circumstances of the given case.
4. The VIP account of a VIP user who violates the GTC or other rules of Amateri.com or the law may be irrevocably deleted by the provider.
5. A VIP user whose VIP account has been deleted for violating the GTC or other rules of Amateri.com or the law is not entitled to a refund or any other compensation.
6. The credits of a VIP user whose VIP account has been deleted for violating the rules according to Article IV, paragraph 4 of the TVIP, expire.
7. VIP membership does not in any way give the VIP user an advantage in terms of tolerating violations of the rules over other users.

V. Final Provisions

1. These TVIP become effective on October 10, 2023.
2. The provider reserves the right to unilaterally change these TVIP.
