Terms of Uploading Content and Behavior at Amateri.com

(“TUC”)

I. Introductory Provisions

  1. These TUC govern the rules for uploading content and the rules of user behaviour on Amateri.com platforms (hereinafter referred to as "Amateri.com").
  2. These TUC supplement the General Terms and Conditions ("GTC") following the provisions of Art XII (5) of the GTC.
  3. Unless otherwise stated, the abbreviations used in the TUC are the same as the abbreviations given in the GTC.

II. Common Provisions for All Types of Content

  1. Content, per the provisions of Art II (1) of the GTC, means text, visual, audiovisual, graphic, photographic or other similar content that can be downloaded, forwarded, sent or modified in a perceptible form ("Content") uploaded to Amateri.com.
  2. All Content, except for content on chat and in private messages (messenger), is subject to the approval of the Operator and its authorised persons before publication.
  3. All Content, including entire user accounts, may be reported after being uploaded and published at Amateri.com by any person who demonstrates a legal interest through reporting; The Operator reserves the right to request evidence to support the reporter's claim.
  4. Content must be erotic unless otherwise stated.
  5. Content must not
    1. insult or attack individuals or groups of persons;
    2. express hatred, especially through hateful symbols and gestures, symbols defaming the human race or otherwise contrary to public order;
    3. initiate or incite conflicts, arguments, violence or disturbances;
    4. initiate or promote topics prohibited by law or other legal regulations;
    5. sell, solicit or refer to the sale of illegal or regulated goods, either directly or indirectly;
    6. link or direct users to other websites;
    7. act fraudulently or provide false information;
    8. violate the copyright law and intellectual property of the author of the Content or the personality and other rights of persons depicted or otherwise appearing in the Content, especially, but not exclusively, by downloading from the Internet or another publicly available source;
    9. provide contact information, except for elements expressly designated for this purpose at Amateri.com, whereby contact information means in particular full name and surname, telephone number, e-mail address, bank account number and username on another platform;
    10. create or publish public lists of undesirable persons (so-called blacklist);
    11. unreasonably annoy other users by repeating it;
    12. depict or in any way mention children or persons under the age of 18 or persons giving the impression that they are children, including in the case of avatars, drawings, anime and other similar categories;
    13. depict or in any way mention animals and sexual practices with them;
    14. depict or in any way refer to blood or anything resembling blood;
    15. carry a visual, audio or other watermark different from the Amateri.com watermark;
    16. be created through algorithms based on neural networks and/or language models (so-called artificial intelligence), except for content that has been improved or supplemented through this technology.
  6. By violating any of the rules mentioned above, the account of the user in question may be partially or completely restricted.
  7. The operator reserves the right to individually assess each Content and its placement at Amateri.com.
  8. A user who has violated GTC, TUC or other regulations and has been restricted in use in any way based on such a violation, is not entitled to a refund or compensation for any services purchased.

III. Text Content Rules (Except Chat)

  1. Text content means blog posts, short stories, text posts, dating site ads, forum posts, personal profile captions, and album and video captions.
  2. The categorisation of text Content in the blog, short story, forum or text post section is decided by the author of such Content, while the Operator reserves the right to change the originally intended categorisation.
  3. The textual content must be classified in the appropriate categories according to its theme.
  4. It is prohibited in textual content to
    1. mock, slander or systematically harass other users and Amateri.com employees and associates;
    2. publish information about victims of crimes, including at the stage of investigation, as well as information about ongoing proceedings before public authorities.
  5. Textual content cannot be used to announce public collections and similar calls.
  6. The length of the text content can be limited by the minimum and maximum number of characters to display it correctly and ensure the flow of the text.

IV. Rules for Photos and Albums

  1. The photo that appears next to the user account is called the profile photo.
  2. It is forbidden to use photos of other people as profile photos, especially of well-known personalities, or photos that are likely to be confused with another person.
  3. Album means a set of photos in a user's profile; When approving, the operator rejects the album with a reason, approves it, or approves it to the profile:
    1. Rejection of the album: the user violated the General Terms and Conditions of Amateri.com or did not comply with the prescribed parameters of the album; the user is informed about the reason for rejection via the notification panel in his profile;
    2. Album approval: After approval, the album is published on the user's profile and in the listing at Amateri.com;
    3. Album profile approval: After approval, the album is published on the user's profile, but not in the listing at Amateri.com.
  4. A user who uploads an album to Amateri.com is strictly prohibited from uploading such Content without the knowledge and consent of the persons appearing in the Content.
  5. To submit an album for approval, 6 to 30 photos must be uploaded to the album, with a maximum size of 10MB per photo.
  6. Photos must be original, not reproduced or otherwise adapted.
  7. Album content should not be duplicated in other albums; it is at the Operator's discretion whether to approve the duplicate upload or not.

V. Rules for Videos

  1. Video means an audiovisual recording in sufficient quality and sharpness of individual shots.
  2. Videos must be at least 15 seconds long.
  3. The maximum size allowed for a single video is 1000MB.
  4. Video approvals are governed by the album approval provisions as appropriate.

VI. Rules for Meetups

  1. A meetup is a meeting organized by a user or a group of Amateri.com users.
  2. To publish the meetup, the organizer contacts the customer support of Amateri.com here, while the Operator and the persons authorized by them subsequently check whether the wording of the meeting does not contradict the General Terms and Conditions of Amateri.com.
  3. The operator of Amateri.com is in no way responsible for the course of the meetup or any damage caused in connection with the meetup.

VII. Rules for Contests

  1. A contest is a time-limited event organized by a user or a group of users, in which users upload Content in a pre-specified category under conditions defined by the organizer.
  2. To publish the contest, the organizer contacts the customer support of Amateri.com here, while the Operator and their authorized persons subsequently check whether the wording of the contest does not contradict the General Terms and Conditions of Amateri.com.
  3. The operator of Amateri.com is in no way responsible for the course of the competition or any damages incurred in connection with the competition.
  4. The operator of Amateri.com expressly excludes the application of the provisions of Art 2873 et seq. Act No. 89/2012 Sb., Civil Code of the Czech law, as amended.

VIII. Rules of Chat and Behaviour

  1. Chat means interaction through messages in a text thread between two or more users within a chat room at Amateri.com.
  2. The administrator of each chat room is a person designated and authorized by the Operator of Amateri.com.
  3. The administrator assesses the permissibility of the behaviour of individual users in a given chat room per the rules of Amateri.com and punishes unacceptable behaviour appropriately and within the limits of these TUC.
  4. The chat room administrator has the following tools at their disposal for remediation in the event of a violation of the rules:
    1. Warning: The user is warned about inappropriate behaviour that violates the rules.
    2. Temporarily Mute: The user is temporarily prevented from contributing to the discussion, but can remain in the room.
    3. Temporarily ban the user from the room: The user is temporarily banned from participating in the chat room.
    4. Permanent ban of the user from the room: The user is permanently banned from participating in the chat room and is prevented from adding in the future.
    5. Temporarily block access to chat: Users are temporarily banned from participating in any chat room.
    6. Retention credits: Retention credits are set in the user's account per the provisions of Art VI of Credit System Rules.
    7. Account cancellation: In exceptional cases, the user's account may be completely cancelled, if the user violates the General Terms and Conditions for a long time.
  5. The administrator of the room is obliged to properly justify the use of any of the tools used to remedy the situation by the user; the use of these tools is possible only based on prior notification of the user by the administrator.
  6. Impersonating an administrator is considered a serious violation of TUC.
  7. It is strictly prohibited in the chat room to
    1. insult, attack or discriminate against anyone based on gender, race, religion, sexual orientation and other criteria,
    2. threaten anyone with violence, provoke arguments and disputes,
    3. enter contact information, offers or requests for erotic services and sex,
    4. use an excessive amount of emoticons that clutter the chat room; similarly, the so-called wallpapering is prohibited, which means the unreasonable repetition of the same text, image or animation to clutter the chat room and thus making the smooth progress of the chat impossible or difficult,
    5. invite other users outside the platform provided and guaranteed by Amateri.com to another, external platform (e.g. Skype or MSN, etc.).
  8. Each room can have its rules, and its content must not contradict the TUC or lower its standard; a summary of the chat rules and their more detailed interpretation is available here.
  9. In the event that a user is excluded by the administrator based on repeated or serious violations of the rules, such user is not entitled to compensation or refund of the purchased services according to Art XI (6) of the GTC.
  10. The Creator (see Rules for Creators) can set up a chat room, the entrance of which is charged with credits ("Monetized Room"), the amount of credits being determined by the creator themself; this amount can be moderated by the operator or a person authorized by them.
  11. Credits paid are assigned to the founder of the given room after deducting the provider's commission; any complaints are governed by the Complaints Policy (see Complaints Policy).
  12. A Monetized room is governed by the rules of Amateri.com and the rules determined by the creator of the room; the rules of the founder must not lower the standard given by the rules of Amateri.com or contradict them in any way, and visitors to such a room are obliged to comply with these rules.
  13. There is no legal right to enter and stay in the Monetized Room, even if the user in question has a prepaid VIP membership; VIP membership is in no way related to the Monetized Room, unless specifically stated otherwise.
  14. The same remediation tools can be applied in the Monetized Room as in any other room; membership in the Monetized Room does not grant its participants increased tolerance in terms of breaking the rules.
  15. The Chat Rules shall also apply reasonably to interactions between users in messenger via private messages and whispers; a whisper is a private conversation between users within a chat room.
  16. A user may restrict access to their messenger by requiring credits to open a conversation with them upon meeting the specified conditions; the current conditions and more detailed information on the establishment of this service are given in the relevant section in the user profile.
  17. Conversations conditional on the payment of credits are subject to the Complaints Policy.

IX. Disclaimer

  1. The Operator of Amateri.com declares that an employment relationship does not arise between them and the user through the use of the portal.
  2. The Operator further declares that the opinions of any persons expressed at Amateri.com may not be following the position and opinions of the Operator, and therefore cannot be considered as the Operator's opinions.
  3. The Operator further declares that, despite all efforts and due care, it is not possible to monitor all user communication on the website.
  4. The Operator is not responsible for the behaviour of individual users on the website, in particular for the activity that violates the law, the protection of the rights of third parties, the copyright law and the protection of privacy and freedom.
  5. The operator has the right to monitor communications, texts and other content that is published on Amateri.com or sent between users, to ensure safety and compliance with the rules.

X. Final Provisions

  1. These TUC take effect on 27/05/2024.
  2. The operator reserves the right to change these TUC unilaterally.
  3. In the event of a discrepancy between the individual language mutations of these TUC, the Czech version prevails.
